Student Enrollment Agreement Terms and Conditions

You have enrolled in a program with The Extra Point, LLC (“The Extra Point ACT Prep”, “we”, “us”, “our”) for the purpose of preparing for a particular high school admissions test or other entry or standardized exam, for high school academic tutoring or for preparing for the college search and application process. All program techniques and materials (online and print) are the exclusive property of The Extra Point, LLC. You agree not to disclose, reproduce, sell or distribute to any third party any information, written or spoken, including course materials, obtained from The Extra Point, LLC in connection with The Extra Point, LLC courses or tutoring programs. You understand that course size is limited and, therefore, enrollment is taken on a first-come, first-served basis.

Program Payment

You have the right to “opt–in” and “opt–out” of certain of our uses of your Personal Information. For example, on this Web Site, you may be able to elect to or not to receive correspondence from us or have your Personal Information shared with other entities for their marketing purposes. You may also make this request by visiting our Manage Your Subscriptions web page and indicating which correspondence you would like to receive. You can send an e–mail to extrapointbr@gmail.com. In this e–mail, please say whether: (i) you would like to opt–out of receiving all e–mail promotional correspondence from The Extra Point, LLC in general or (ii) if you would only like to opt–out of certain of The Extra Point, LLC e–newsletters or correspondence and if so which ones or (iii) you would like to opt–out of having your Personal Information shared with third parties or (iv) you would like to opt–out of receiving SMS or text messages. You may also opt–out of The Extra Point, LLC promotional e–mails by clicking on an opt–out link within the e–mail you receive.

Please understand that if you opt–out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.

Program Cancellation

Occasionally, due to various circumstances, The Extra Point, LLC may change course schedules or locations, cancel a course, not have a tutor available for you or not be able to fulfill your Small Group Instruction request. If we cancel the course in which you have enrolled and are not able to reschedule you into another course that is acceptable to you, or if we are unable to match you with a tutor or Small Group Instruction, we will refund all of the tuition you have paid (including your deposit), and we will have no further liability to you with regard to the cancelled program. If you have received any program materials, you must return them to us, at The Extra Point’s expense for shipping in accordance with The Extra Point’s return authorization policy, within two weeks of the program cancellation. If you fail to return materials within the two-week period, and (i) if you were registered for a classroom course, LiveOnline course or Small Group Instruction, we will refund all of the tuition paid less your deposit, or (ii) if you were registered for a tutoring program, The Extra Point will deduct a fee of $200 or (iii) if you were registered for an Online course, The Extra Point will deduct the lower of$200 or the full price of the course. Please note that refunds for cancellations under this or the immediately preceding section take approximately 30 days from notification of cancellation to be processed.

Lost Material

If you lose your program materials, you may purchase a replacement kit for your PSAT or ACT materials for $50.00 during the course of your program.

Student Withdrawals and Refunds

If you choose to withdraw your enrollment in a classroom course, LiveOnline course or a Small Group Instruction ten or more days before the first scheduled session of your program, we will refund all of the tuition you have paid (including your deposit). If you decide to withdraw your enrollment in a classroom course, LiveOnline course or a Small Group Instruction less than ten days before the first scheduled session of your program, we will refund all of the tuition you have paid less your deposit. No refunds will be given after the first scheduled session of the program in which you enrolled.

If you choose to withdraw your enrollment in a private tutoring program (in-person or on-line) or in any of our online programs other than LiveOnline within 48 hours after your enrollment in such program, we will refund all of the tuition you have paid. If you choose to withdraw your enrollment for private tutoring (in-person or on-line) more than 48 hours after your enrollment but prior to the first session of your program, we will refund all of the tuition you paid less a fee of $200. Please note that no refunds are available after 48 hours from the time of enrollment for any of our online programs other than LiveOnline courses and online private tutorials.

In order to receive a refund as set forth above, you must return any program materials you received to us unopened and with no marks in the materials within two weeks of withdrawing your enrollment. Shipping costs for return of materials are at your expense. If you fail to return your program materials within two weeks, or do not return them unopened and unmarked and (i) if you were registered for a classroom course, LiveOnline course or Small Group Instruction, The Extra Point will deduct your deposit from any refund for which you are eligible, or (ii) if you were registered for a tutoring program and you were otherwise eligible for a full refund, The Extra Point will deduct a fee of $200, or (iii) if you were registered for an Online course and you are otherwise eligible for a refund, The Extra Point will deduct the lower of $200 or the full price of the course.

Dismissal from Program or Online Access

The Extra Point may dismiss you from the program if you have not paid in full by the first scheduled session or if you, in The Extra Point’s opinion, are disruptive in the program. The Extra Point will not refund any amounts paid by students who are dismissed from a program. The Extra Point may also disable your access to any online resource we provide if you do not comply with our terms of use or other rules and procedures applicable to such resource. In such event, you will not be given any credit or refund.

Governing Law

This Enrollment Agreement and any claim or dispute arising out of, relating to or in connection with this Enrollment Agreement or the transactions contemplated hereby, whether in contract, tort or otherwise, shall be governed by and construed in accordance with the laws of the State of Louisiana without giving effect to its conflicts of law principles.

For Students Enrolling in a Private Tutoring Program

You have purchased a private tutorial for the number of hours indicated in your enrollment form. Please note that session lengths are variable; the number of hours you have purchased does not necessarily correspond to the number of sessions you will have if you choose to meet for more than one hour at a time. Also, The Extra Point does not refund unused tutoring hours

Payment for Additional Tutoring Hours

If you complete more tutoring hours than the number for which you enrolled, you authorize The Extra Point to charge your credit card or debit account for the additional hours you have used at the undiscounted rate of your original purchase. Without limiting the foregoing, additional tutoring hours will not be eligible for any discount, promotion or rebate. Speak regularly with your tutor throughout the tutorial so you know how many hours you have completed.

Adult Supervision

Please note that The Extra Point’s tutors are not permitted to meet in person with a minor student in a private home unless another adult is present during the entire session. If a tutor arrives for a session and an adult is not present, the tutor will not be able to conduct the session, it will be considered a session cancelled by the student without adequate notice, and you will be charged for the session. If the other adult leaves in the middle of a session with a minor student, the tutor will also leave at that time, and you will be charged for the entire session. Tutors may meet in person with minor students in public locations, such as a library or coffee shop, without another adult present.

Canceling Tutoring Sessions

If you need to cancel a scheduled tutoring session, YOU MUST GIVE THE TUTOR 24 HOURS ADVANCE NOTICE. If you fail to give 24 hours advance notice of any cancellation, the missed session will be treated for purposes of remaining tutoring hours, as if the session took place. If the tutor cancels or misses an appointment without 24 hours advance notice to you, you will receive one free session of equivalent hours to the missed session of tutoring in addition to the hours in your program.

Tutor Satisfaction

 If you are not happy with the tutor we have assigned to you, please contact The Extra Point before your second tutorial session. We will assign a new tutor and we will not charge you for the first session. While you may still request a change in the tutor assigned to you after your second tutorial session, we will charge you for all hours used, including those with the original tutor.

Forfeiture of Tutoring Hours

If after you have had your first or subsequent tutoring sessions, there is no tutoring session scheduled for you for over a 90 day period, all unused tutoring hours will be forfeited.

For Students Enrolling in a Program for High School Students

We guarantee your satisfaction. The Extra Point’s guarantee offers—Readiness, Satisfaction or Money Back—and the program to which they apply are described below. Each eligible student may choose only one of the applicable guarantee offers. The Extra Point’s PSAT programs and Online courses are not eligible for any guarantee. Further, The Extra Point’s Guarantee does not apply to any free session offered by The Extra Point or to courses not listed on this website (e.g., courses offered through schools or other institutions, unless specifically indicated in The Extra Point written program descriptions). Readiness Guarantee

If you are enrolled in our ACT Classroom Course and at the end of the program, you do not feel ready to take the test for which you prepared in your ACT Classroom Course, you may retake our ACT Classroom Course for such test at no charge other than a $50 administrative fee, within one year following the start of your program, provided you meet the requirements set forth at the end of this Guarantee. If an ACT Classroom Course is not available within 90 days of your request, you may take, our full Online Course for the test for which you prepared in your ACT Classroom Course sessions.

To qualify for the Readiness Guarantee for the eligible programs as described above, you must meet the following requirements:

    • Within the schedule required by your program, you attend all of the program sessions, take all assigned practice tests, and complete all of your homework.
    • If you repeat a course under this Readiness Guarantee, you will not be provided with a new set of program materials. However, you may purchase a replacement set of program materials for $50.00. Please note that if you exercise this Readiness Guarantee, you will not be eligible for our other guarantee offers.

Satisfaction Guarantee

Regardless of how much your test score improves, you are eligible to continue working with The Extra Point at no additional charge (other than an administrative fee in certain instances described below) for one year following the start of your program if you were in one of the programs specified below and meet the requirements set forth at the end of this Guarantee.

    • ACT Classroom Course students may retake our Classroom Course or take our Online course if Classroom Course is not available within 90 days of your request.
    • Online ACT course students can repeat the Online program in which you were initially enrolled.
    • ACT private tutoring students who have completed at least 5 hours of instruction may take our Online course for the test for which you prepared in your online comprehensive tutoring sessions.

To qualify for the Satisfaction Guarantee for the eligible programs as described above, you must meet the following requirements:

    • Within the schedule required by your program, you attend all of the program sessions, take all assigned practice tests, and complete all of your homework.
    • You pay an administrative fee of $50.

Please note that if you exercise this Satisfaction Guarantee, you will not be eligible for other guarantee offers.

Money Back Guarantee

If you take our ACT Classroom Course and your test score for the test that was the subject of your in-classroom course does not improve, you are eligible for a 50% refund, if you meet the following requirements: 

    • Within the schedule required by your program, you attend all of the program sessions, take all assigned practice tests, and complete all of your homework.
    • You take the official test for which you prepared within 30 days following the final session of your program except in the case of an ACT program you take the next official ACT test administration following the final session of your program.
    • You present your official test score report(s) to us and request the refund within 30 days following the official test.

How we measure improvement:

    • For purposes of measuring improvement for the above Money Back Guarantee, we consider an official test score to be your composite ACT score, as applicable.
    • If you have taken an official ACT test six months or less before the start of The Extra Point’s program, we will compare your prior official ACT, as applicable, score to your official score on the test you take within 30 days following the final session of your program.
    • If you have not taken an official ACT test six months or less before the start of The Extra Point’s program, we will compare the results of your first practice test in our program to your score on the official test you take within 30 days following the final session of your program.

Please note that if you exercise the above Money Back Guarantee, you will not be eligible for our other guarantee offers.

Refunds for purposes of the Money Back Guarantee take approximately 30 days to be processed from the date of submitting a fully completed request.
